Liability Waiver:
This waiver releases Fit Mommy Charleston, LLC, its members, agents, employees, volunteers, and assigns from all liability relating to injuries that may occur during exercise or while attending a class. By executing this waiver, I agree to hold Fit Mommy Charleston, LLC its members, agents, employees, volunteers, and assigns entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence; including but not limited to: - Participation in any activity, exercise, class, or program;
- The sudden and unforeseen malfunctioning of any equipment, whether or not said equipment is under the control or use of Fit Mommy Charleston, LLC;
- Instruction, training, or supervision;
- Park facilities;
- Transportation to or from classes.
By executing this waiver, I understand that classes are held in public parks, that the facilities are in no way under the care or control of Fit Mommy Charleston, LLC its members, agents, employees, volunteers, and assigns, and affirm that I am participating in all activities voluntarily and that all potential foreseeable risks have been made clear to me. Additionally, I affirm that I do not have any conditions, including allergies, that will increase my likelihood of experiencing death or injury while engaging in-class activities or interacting with other participants.
By way of my execution below, I forfeit any and all rights to bring suit or claim against Fit Mommy Charleston, LLC its members, agents, employees, volunteers, and assigns for any reason. Additionally, I affirm my understanding that Fit Mommy Charleston, LLC does not warrant any equipment used for class participation; or warrant any outcome from participation. In return, I will be given the opportunity to participate in classes as outlined in the Class Participation Agreement. I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally and will ask for clarification when needed.
For purposes of this waiver "I" shall refer to the participant, participant's child(ren), friends, family, or the like, in attendance with or under the control of the participant.
If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this waiver shall remain in full force and effect the offending provision or provisions severed.
